A growing area of crime over the past twenty years is that of credit card fraud and abuse. Credit card and debit card fraud can be committed (or alleged) in a variety of ways.

Texas is one of many states throughout the country that has a specific criminal statute dealing with credit card fraud and credit card abuse. Under Texas’s statute, a person violates the credit card fraud and abuse statute if they:

  • Use another’s debit or credit card without consent and intends to fraudulently receive a benefit
  • Uses a fake card or card number
  • Steals, receives, buys, or sells a card or number with the intent to use it for their gain
  • Forces a cardholder to pay for something they are unable to repay

It is important to recognize available defense strategies for people accused of credit or debit card fraud or abuse. Notable defenses to these charges include of lack of intent to obtain a benefit, lack of knowledge of having possession of the card, or mistakenly believing that one had authorization to use the card.
